一、证人出庭作证的程序问题
1.证人资格的确认：根据《民事诉讼证据规定》（2019）第七十条的规定：“人民法院准许证人出庭作证申请的，应当向证人送达通知书并告知双方当事人……当事人申请证人出庭作证的事项与待证事实无关，或者没有通知证人出庭作证必要的，人民法院不予准许当事人的申请。”由此可知，证人资格的审查权在法院，未收到法院出庭通知书的不具备证人资格，不能出庭作证。
